Terms of Service
These terms govern your use of hitEveryNote (the “Service”). By creating an account or using the Service, you agree to them.
1. Who we are
The Service is operated by Fleșter Iulian, an individual based in Romania, via the website hiteverynote.com. Contact: contact@hiteverynote.com.
2. Eligibility
You must be at least 16 years old to use the Service.
3. Sign-up and invite links
Anyone can create an account. You may share your personal invite link to bring friends; we may disable links that are abused (e.g. spam).
4. Your account
Provide accurate information, keep your password secure, and do not share your account. You are responsible for activity under your account. Choose a nickname that is not offensive or misleading; we may change or remove nicknames that break these rules.
5. Acceptable use
Use the Service fairly. Do not cheat or manipulate scores or leaderboards, do not attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service, and do not use it for anything unlawful.
6. Your content
Content you create in the Service (patterns, bass presets, comments, messages) remains yours. You grant us the limited permission needed to store and display it so the Service can work — for public patterns and comments, that means showing them to everyone. As the author of a public pattern you decide whether others may export it to MIDI. You are responsible for what you post. Deleting your account deletes your content, including replies others wrote under your comments.
6a. Community rules and moderation
Comments and messages must be respectful: no swearing, insults, harassment, spam, illegal or immoral content, and no personal data (email addresses are blocked automatically). At most one link per comment or message. You can post one comment every 5 minutes and edit it until someone replies; you can delete it at any time (its replies are deleted too).
The community moderates first: a reported comment is collapsed as “hidden by the community” until it gets at least 10 times more likes than reports. We step in when content is immoral or illegal, and our decision is final.
Breaking the rules leads to strikes, counted over the last 3 months: the 1st is a warning by email, the 2nd a 2-day suspension, and each further strike doubles the suspension (up to 90 days). A suspended account can still learn and play, but cannot comment, like, report, send messages, create or publish patterns, or export MIDI. Accounts used for spam or run by bots may be blocked permanently.
The same rules apply to the feature requests board: one idea should describe one feature, duplicates and off-topic or abusive posts may be hidden or removed, and you can post up to 3 ideas per day. We decide what to build; voting helps us prioritise but does not oblige us to build anything.
Private messages are for members aged 16 or older who turned them on. Someone who writes to you first can send one message until you reply, and you can block anyone at any time.
6b. Third-party services and ads
The Service uses third-party tools such as Google Analytics and, in the future, Google AdSense. They are used only according to your choice in the cookie banner; see the Cookie Policy and Privacy Policy. We are not responsible for the content of third-party advertisers or sites linked from the Service.
7. Availability and beta
The Service is provided on an “as is” and “as available” basis and is under active development. Features may change, and the Service may be unavailable at times. We make no warranties that it will be uninterrupted or error-free.
8. Suspension and termination
We may suspend or close accounts that break these terms, as described in section 6a. You can stop using the Service and delete your account at any time.
9. Liability
To the extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the Service. Nothing in these terms limits liability that cannot be limited by law.
10. Governing law
These terms are governed by the laws of Romania, and any disputes are subject to the competent Romanian courts, without affecting mandatory consumer protections you may have.
11. Changes
We may update these terms. Continued use after changes means you accept the updated terms.
12. Service provider identification
In accordance with applicable e-commerce law (Law 365/2002), the service provider is Fleșter Iulian, Romania, reachable at contact@hiteverynote.com.
